SouthCoastToday.com: The Buzzards Bay Coalition is accusing the EPA and AVX of using a “false” distinction in their defense of the $366 million [New Bedford Harbor] cleanup settlement.
In two memorandums filed in court last week, the coalition disputed claims by the Environmental Protection Agency and AVX that the effort to make AVX responsible for any cost overruns in the New Bedford Harbor Cleanup does not apply to the case.
In their own briefs to U.S. District Court in Boston, the EPA and AVX called the $366 million agreement a “cost recovery” rather than a “cleanup settlement.”
